TERMS & CONDITIONS
Please read through the terms and conditions thoroughly before enrolling. By enrolling in a class at Kefi Studio, you agree to the terms and conditions as laid out on the Kefi Studio Pilates website. You can also see these terms and conditions when booking a class on the app and website.

By accessing any Membership, goods, or services provided by Kefi Studio Pilates, you acknowledge and agree to abide by these Terms and Conditions. Please read and understand these Terms and Conditions before proceeding. Additionally:
1.1. You have received a copy of these Terms and Conditions, read and comprehend them, and consent to comply with their provisions.
1.2. No terms and conditions from any of your documents will supersede or modify these Terms and Conditions in any way.
1.3. Kefi Studio Pilates reserves the right to amend these Terms and Conditions by providing written notice. Your continued use of Kefi Studio Pilates' goods and/or services or maintenance of your Membership will constitute acceptance of any such amendments.

2.1 This clause governs all New Client Intro Offers offered by the Studio across its class formats, including (without limitation) group class intros, private session start packs, and small group equipment start packs. Specific intro products and pricing are listed at point of sale and on our website.
2.2 Intro offers are available to new clients only. “New client” means a person who has not previously held a paid membership, class pack, or pass with the Studio across any class format at either Studio location.
2.3 All intro offers must be activated by booking your first class within 14 days of purchase. If not activated within 14 days, the offer expires and is non-refundable.
2.4 Once activated, intro offers are valid for 14 consecutive days from the date of your first booked class, regardless of how many classes you attend within that period.
2.5 Each new client may purchase one intro offer only across all formats. A client who has used a group class intro offer is not eligible for a separate private session or small group equipment intro offer.
2.6 Intro offers cannot be refunded, paused, extended, or transferred to another person.
2.7 If we identify a client who has purchased more than one intro offer, we may suspend the account and charge the casual rate for any classes attended under additional offers.

3.1 Membership Types
(a) No Lock-In Membership. Recurring weekly direct debit with no minimum term. You may cancel at any time on 30 days’ written notice.
(b) 12-Month Membership. A 12-month minimum term at a discounted weekly rate. After the 12-month term, the membership continues on a week-to-week basis at the same discounted rate until cancelled with 30 days’ written notice. Early termination is governed by clause 3.5.
(c) Both membership types are personal to you and cannot be shared, transferred, or assigned.
3.2 Class Allocation, Rollovers and Add-Ons
(a) Unused classes from your weekly allocation roll over for up to 2 weeks. Classes that remain unused after 2 weeks expire and are not refunded. Unlocked Memberships are not subject to rollover.
(b) Active Uno, Duo, and Trio members may book additional casual sessions at a discounted member rate. Additional sessions purchased under this clause are valid for 7 days from purchase.
3.3 Cancelling a No Lock-In Membership
(a) You may cancel your No Lock-In Membership at any time by emailing hello@kefistudiopilates.com.au. Cancellation takes effect 30 calendar days from the date the email is sent.
(b) Notices given by phone, social media, in-person conversation, or to any other email address are not valid.
(c) Direct debits will continue and you may attend classes during the 30-day notice period.
3.4 Cancelling a 12-Month Membership Early
(a) The 12-Month Membership is offered at a discount in exchange for your commitment to a 12-month term. If you cancel before the 12-month term is complete, an Early Termination Fee of $150 applies, in addition to the standard 30-day notice period.
(b) The Early Termination Fee may be waived where you provide reasonable supporting evidence of: (i) a permanent medical condition that prevents you from participating, certified by a registered medical practitioner; (ii) a relocation of your principal residence to a place more than 20 km from both Studio locations; or (iii) demonstrated financial hardship. The 30-day notice still applies in these cases.
(c) After the 12-month term is complete, the membership continues on a week-to-week basis at the same discounted rate. From that point cancellation requires only 30 days’ written notice and no Early Termination Fee applies. The Studio operates a 30-day Free Cancellation Window before each renewal point.
3.5 Membership Freezes
(a) You may freeze your membership up to 6 weeks per calendar year, for a minimum of 7 days and a maximum of 6 weeks per freeze.
(b) Freeze requests must be submitted in writing to hello@kefistudiopilates.com.au with at least 7 days’ notice before the freeze start date. There is no freeze fee.
(c) Exceptions to the freeze limits may be granted at the Studio’s discretion, and only with reasonable supporting evidence, in cases of: (i) medical condition or injury (medical certificate required); or (ii) genuine family emergency.
(d) Freezes extend a 12-Month Membership term day-for-day, so that you receive the full 12 months of active membership.

4.1. To book a Class, please use the Kefi Studio Pilates App or visit the Kefi Studio Pilates Website.
4.2. Class bookings are subject to availability, which is determined at the discretion of Kefi Studio Pilates.
4.3. To reserve a spot in a Class, you must either be a Member with prepaid Fees or make payment at the time of booking to become a Member.
4.4. Payment of Fees must be made according to the payment terms specified in clause 3 for the purchase of Periodic Subscriptions or clause 4 for the purchase of Class Packs.
4.5. Please note that Class availability is on a first-come, first-served basis. To avoid disappointment, Classes can be booked up to 4 weeks in advance.
4.6. If you are unable to attend a booked Class, please ensure that you cancel in a timely manner to allow others the opportunity to book that spot.
4.7. In the event of a Class cancellation due to unforeseen circumstances, you will be promptly notified via text, phone, or email (as applicable), provided that you have provided us with your contact details.

If a class is full, you may join the waitlist via the Studio app or website. When a booked client cancels, the first person on the waitlist is offered the spot by text message and has 30 minutes to accept. If the offer is not accepted within 15 minutes, it passes to the next person on the waitlist, and so on.
Waitlist offers stop 1 hour before class starts. Spots that open inside that final hour are not filled from the waitlist.
Once you accept a waitlist spot, you are booked into the class and the standard 7-hour cancellation policy in clause 5.1 applies from the time of class start. Late cancellations and no-shows are subject to the fees in clause 5.2.
If you have used all of your weekly class allocation or pack credits at the time a spot opens, the system cannot automatically book you in. To remain eligible to be promoted from the waitlist, you must either: (i) cancel another booked class to free a credit; or (ii) join the waitlist with valid card details on file, in which case you authorise the Studio to charge you for an additional casual class if you are promoted from the list.
Joining a waitlist is a commitment to attend. If your plans change, you must remove yourself from the waitlist via your schedule as early as possible. Repeated failure to respond to waitlist offers, or repeated no-shows after being promoted from the waitlist, may result in waitlist privileges being suspended.

6.1. You are required to adhere to the Code of Conduct at all times while present at a Kefi Studio Pilates Location.
6.2. You acknowledge and consent that Kefi Studio Pilates conducts continuous Closed Circuit Television (CCTV) monitoring for security purposes. Additionally, Kefi Studio Pilates may occasionally capture photographs, audio, or videos for promotional and marketing purposes. You agree to the recording of your image, video, or audio at a Kefi Studio Pilates Location for such purposes.
6.3. Before the start of each Class, you must inform and disclose to Kefi Studio Pilates Staff any injuries, illnesses, or any medical conditions that may affect your ability to participate in the Class activities or use Kefi Studio Pilates's equipment or facilities.
6.4. Any injuries or accidents that occur during a Class must be immediately reported to Kefi Studio Pilates Staff.
6.5. If you have not booked into a Class, it is advisable to call and confirm whether the Classes are taking place, especially during early morning and late evening hours, to avoid any disappointment.
6.6. To ensure the safety of Kefi Studio Pilates Trainers, other Members, and yourself, the warm-up at the beginning of each Class is a crucial part of the session. Please note that we don’t allow clients in class after the class has started. In such cases, your credit for that Class will not be redeemed.
6.7. Kefi Studio Pilates, including Kefi Studio Pilates Trainers, reserve the right to restrict Members to specific Class types or limit certain activities or the use of particular equipment or facilities based on health and safety considerations. Furthermore, Kefi Studio Pilates, including Kefi Studio Pilates Trainers, reserve the right to deny your participation in a Class if we believe that you are not medically fit or capable of performing the Class activities or using Kefi Studio Pilates's equipment or facilities.
6.8. Classes booked by a Member are non-transferable to another individual or Member under any circumstances. They cannot be used by anyone other than the Member who made the booking. If someone other than the registered Member arrives to attend the Class, they will be refused entry or asked to purchase their own Membership.
6.9. In the event of theft or any inappropriate or unlawful behaviour witnessed or experienced by you, it must be promptly reported to Kefi Studio Pilates Staff.
6.10. It is your responsibility to take care of your personal belongings (e.g., keys, wallets) while you are at a Kefi Studio Pilates Location. Valuables should not be brought into the premises. If you choose to bring personal belongings to Kefi Studio Pilates, please ensure they are kept on your person at all times or secured in the available lockers (subject to availability).
6.11. For safety reasons, bags are not allowed on the floors of any Kefi Studio Pilates Location.
6.12. Any found lost property should be immediately handed over to the reception at the respective Kefi Studio Pilates Location. Lost property items will be held for a reasonable period before being donated to charity.
6.13. Access to a Kefi Studio Pilates Location is only granted to Members during Class hours, provided they have made a booking.
6.14. Kefi Studio Pilates reserves the right to remove you from a Class or the Kefi Studio Pilates Location if, in our opinion, you violate any of the aforementioned requirements or fail to comply with these Terms and Conditions.

By using our services, you agree to adhere to the following code of conduct:
7.1. Use all equipment with care and follow the instructions provided by Kefi Studio Pilates Staff.
7.2. Respect and comply with the directions given by Kefi Studio Pilates Staff at all times.
7.3. Read and follow all signs and instructions displayed throughout the Kefi Studio Pilates Location.
7.4. Act in a safe, hygienic, appropriate, and lawful manner at all times.
7.5. Refrain from causing any loss or damage to the property of Kefi Studio Pilates or any other person.
7.6. Avoid disrupting or harming other Members or Classes in any way.
7.7. Be respectful and courteous to all individuals within a Kefi Studio Pilates Location.
7.8. Provide accurate and truthful information to Kefi Studio Pilates and refrain from misleading or providing false information.
7.9. Obtain express permission from Kefi Studio Pilates before using camera and audio recording devices at any Kefi Studio Pilates Location.
7.10. Promptly provide confirmation of your booking upon request by a trainer/owner.
7.11. Refrain from consuming alcohol or smoking cigarettes/vapes at any Kefi Studio Pilates Location.

8.1. Minors between the ages of 14 and 18 years may be eligible to become a Member with the written consent and signature of their parent or legal guardian.
8.2. Minors must comply with all safety requirements of Kefi Studio Pilates as directed by Kefi Studio Pilates Staff.
8.3. Kefi Studio Pilates reserves the right to cancel the Membership of a minor for inappropriate behaviour, equipment misuse, or failure to comply with directions from Kefi Studio Pilates.

9.1. As a condition of your Membership, you agree to pay your Fees via Credit card on file and complete and sign a card Debit Agreement when purchasing your membership.
9.2. Your credit card will be debited for the Fees due under these Terms and Conditions.
9.3. If you fail to comply with the Direct Debit Agreement, Kefi Studio Pilates will attempt to contact you for payment resolution. After the second attempt, a fee of $10 may will charged for failed payments.
9.4. Failure to pay the Fees by the due date may result in refusal of entry to Kefi Studio Pilates and cancellation of Membership.

10.1. To cancel a booked Class, you must do so through your profile on the Kefi Studio Pilates branded app, website, or booking system as soon as possible.
10.2. For Members with a Kefi Unlocked Membership cancelling a Class less than 7 hours before its start will result in a $15 cancellation fee.
10.3. For Members with limited Memberships or limited Class Packs, cancelling a Class less than 7 hours before its start will result in the loss of the Class credit.
10.4. Absence from a Class without cancellation will be subject to the same rules mentioned in clauses 10.2 and 10.3 based on the Member's Membership type or Class Pack.
10.5. Contact the Kefi Studio Pilates team to discuss refund or credit options for unforeseen circumstances, at the discretion of the Kefi Studio Pilates team.

6.1 Member Discounts
(a) Active Uno, Duo, and Trio members can purchase a top up credit for $23 when booking additional sessions. Unlocked Members do not receive this discount as their plan is unlimited.
(b) All active members receive 10% off privates, merchandise, and retail products.
6.2 Student and Concession Discount
Full-time students and current concession card holders are eligible for a 10% discount on standard pricing (excluding the New Client Intro Offer and existing student packs and memberships, which already include a discount), upon verification of valid identification.
6.3 Referral Programme
(a) Active members may refer new clients under the “Give $30, Get $30” programme: when a referred new client purchases a paid product (excluding the New Client Intro Offer), the referrer receives a $30 account credit and the new client receives $30 off their first purchase.
(b) Referral credits expire 6 months from the date of issue and have no cash value.
(c) The Studio may modify or withdraw the referral programme at any time on reasonable notice.
6.4 General
Discounts and credits are not transferable, cannot be combined with any other offer, and may be withdrawn if eligibility criteria are no longer met.

12.1 Kefi Studio Pilates may suspend your Membership immediately if you fail to comply with the Terms and Conditions. We will provide written notification regarding the recommencement of your Membership.
12.2 Clients on a weekly membership can suspend their membership by providing written notice to Kefi Studio Pilates at least 7 working days prior to the intended recommencement date.
12.3 The validity period of Class Packs cannot be extended.

13.1 By participating in Classes and using the equipment and facilities at Kefi Studio Pilates, you warrant and represent that you are medically fit to undertake physically demanding exercises conducted during Classes.
13.2 You acknowledge and agree that your attendance at Classes and use of Kefi Studio Pilates' equipment and facilities are undertaken at your sole risk and responsibility. You are fully aware that the Classes are physically demanding and could pose a risk to your health if you are not medically fit.
13.3 Kefi Studio Pilates accepts no responsibility for any loss or damage to your personal property. You acknowledge and agree that you bring any personal property onto Kefi Studio Pilates Locations at your own risk and responsibility.
13.4 To the extent permitted by law, you unconditionally and irrevocably release Kefi Studio Pilates from any liability and claims arising from personal injury, illness, death, or loss or damage to personal property, both present and future.
13.5 To the extent permitted by law, all implied warranties, guarantees, and terms in connection with these Terms and Conditions are excluded. Kefi Studio Pilates' liability, where it cannot be excluded by law, is limited to:
(a) Repair or resupply of equivalent goods, or refund of any amount paid by the Member to Kefi Studio Pilates in relation to those goods.
(b) Re-performing the relevant services, or refund of any amount paid by the Member to Kefi Studio Pilates in relation to those services.
13.6 To the extent permitted by law, Kefi Studio Pilates excludes any liability to a Member (whether under contract, tort, statute, equity, or indemnity) for any indirect, special, or consequential loss or damage, including loss of opportunity, loss of profit or revenue, loss under any third-party arrangements, or other losses not reasonably considered to arise naturally from the relevant breach, event, fact, matter, or circumstance.
13.7 To the extent permitted by law, Kefi Studio Pilates' aggregate maximum liability to the Member arising from these Terms and Conditions (whether under contract, tort, statute, equity, or indemnity) is limited to the Fees paid by the Member in the previous 6 months.

14.1. These Terms and Conditions represent the complete agreement between the Member and Kefi Studio Pilates concerning the subject matter and replace any prior written or oral agreements.
14.2 If any provision of these Terms and Conditions is prohibited, invalid, or unenforceable, it will be ineffective to the extent of the prohibition, invalidity, or unenforceability without invalidating the remaining provisions unless it significantly alters the nature or material terms of these Terms and Conditions.
14.3 Any notices or communications between parties under these Terms and Conditions must be in writing and can be delivered in person, by email, or by post to the recipient's specified address or any new address communicated by the recipient.
14.4 Any confidential or sensitive information disclosed by Kefi Studio Pilates must only be used for the purposes explicitly specified. You are obligated to keep such confidential information confidential unless it becomes public knowledge (not due to a breach of these Terms and Conditions) or disclosure is required by law or a regulatory body.
14.5 Kefi Studio Pilates' obligations under these Terms and Conditions will be suspended during events of Force Majeure, which are circumstances beyond its reasonable control, such as pandemics, natural disasters, government actions, or supplier/subcontractor failures.
14.6 Members are not permitted to assign any rights under these Terms and Conditions without prior written consent from Kefi Studio Pilates.
14.7 Nothing in this agreement is intended to create an employment, agency, partnership, fiduciary, or joint venture relationship between Kefi Studio Pilates and any Member.
